Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Second Talent platform at mango.secondtalent.com and related services (the “Service”) operated by Second Talent (“Second Talent,” “we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract to use the Service. When you create an account — including via third‑party sign‑in such as Google — you agree to provide accurate, current, and complete information and to keep it updated. You are responsible for all activity under your account and for maintaining the confidentiality of your login credentials. Notify us promptly of any unauthorized use.

2. The Service

Second Talent operates a marketplace that connects employers (“Employers”) with engineering professionals (“Candidates”). Candidates create profiles; Employers discover, save, and request introductions to Candidates. Second Talent facilitates these connections but is not a party to, and is not responsible for, any employment, contractor, or other relationship that results between Candidates and Employers.

3. Acceptable use

You agree not to:

• Provide false, misleading, or fraudulent information, or impersonate any person or entity;
• Use the Service for any unlawful, infringing, harassing, or harmful purpose;
• Scrape, harvest, or collect data about other users except as permitted by the Service’s intended functionality;
• Attempt to gain unauthorized access to the Service, other accounts, or our systems, or interfere with or disrupt the Service;
• Upload viruses or malicious code, or circumvent security or access controls; or
• Use information obtained through the Service to contact, solicit, or recruit users outside the Service in a manner that circumvents Second Talent.

4. Candidate terms

Candidates are responsible for the accuracy of their profiles and represent that they have the right to share the information and materials they provide. By submitting a profile, you grant Second Talent a license to display and share it with Employers and to use it to operate and promote the matching service. Participation in the talent network may be subject to vetting, and we may decline or remove profiles at our discretion.

5. Employer terms

Employers represent that they will use the Service only for legitimate hiring purposes and will comply with all applicable employment, anti‑discrimination, and data protection laws when evaluating and contacting Candidates. Employers are solely responsible for their hiring decisions and for any agreements they enter into with Candidates.

6. Fees

Certain features of the Service may be offered subject to fees, which will be disclosed to you before you incur them. Unless otherwise agreed in writing, creating an account and browsing talent does not require upfront payment. We may change our fees prospectively upon notice.

7. Intellectual property

The Service, including its software, design, text, graphics, logos, and the “Second Talent” brand, is owned by Second Talent or its licensors and is protected by intellectual property laws. We grant you a limited, non‑exclusive, non‑transferable, revocable license to use the Service for its intended purpose. You retain ownership of the content you submit, subject to the licenses granted in these Terms.

8. Confidentiality

Information made available through the Service, including Candidate profiles and Employer requirements, may be confidential. You agree to use such information only for purposes of the Service and not to disclose it to third parties except as necessary to pursue a legitimate hiring relationship.

9. Third‑party services

The Service relies on and may link to third‑party services (such as authentication, hosting, and email providers). We are not responsible for the content, policies, or practices of any third party, and your use of those services may be subject to their own terms.

10. Disclaimers

The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non‑infringement. We do not warrant that the Service will be uninterrupted, secure, or error‑free, or that any match, introduction, or hire will result from your use of the Service.

11. Limitation of liability

To the maximum extent permitted by law, Second Talent and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amounts you paid us in the twelve months before the claim or USD 100.

12. Indemnification

You agree to indemnify and hold harmless Second Talent from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Service, your content, or your violation of these Terms or applicable law.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms or if we discontinue the Service. You may stop using the Service and request deletion of your account at any time. Provisions that by their nature should survive termination will survive.

14. Governing law

These Terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to its conflict‑of‑laws rules, and the courts located there will have exclusive jurisdiction over any disputes, unless otherwise required by applicable law.

15. Changes to these Terms

We may modify these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms.
